New Jersey is very unique, as it is one of the few states in the United States where divorced people are required to contribute to their children's college education.

This may not sound very romantic, but in the eyes of the Court, marriage is a legal contract between two parties. Divorce is the legal step required to break the contract between the contractual parties, with the children having some interest in the outcome. In New Jersey, this may include an interest in their college education.

Due to the overall adversarial nature of the process of divorce, sometimes it is difficult for people to understand why they are obligated to help pay for the higher education of a child who has chosen sides, and may not even be speaking to them. Parents can only be held responsible for their children's college education only after they have applied for all eligible scholarships, financial aid and loans. The parents are then responsible for the remaining balance of what is needed for a child to continue their education, in accordance with his/her ability to contribute based upon his/her financial circumstances.

Whatever the dollar amount turns out to be, it will be allocated between the two parties. The financial responsibility is assigned to each person based on their incomes and assets. Each case is different in regard to financial circumstances. There are some people who are ordered to pay substantially, whereas others are only required to pay a small amount.
