Divorce Issues Take Time to Resolve
Let’s face it: when you come to a place where you have decided to divorce, your emotions are running rampant. If you believe that you will be able to detach yourself from several years of marriage in a matter of weeks, then think again. Most of the time, it doesn’t work that way. It generally takes 10 to 12 months (on average) to finalize a divorce from the date a spouse files the complaint.
Divorce is an emotional process just as much as a legal process, and a case resolves when all parties are able to get their emotions in order so they can come to the table and be reasonable.
There will be complex issues and possible disputes over:
- Custody and parenting time with the children
- What happens with the house, the car and other marital property
- How does the debt and get divided
- Spousal support, both during the separation and after the divorce
- Child support, including long-term special needs and college expenses
At The Law Office of Jennifer J. McCaskill, LLC, in Red Bank, we know how frustrating it can be to face such a long process when all you want to do is get on with your life. We have years of experience guiding people through their divorce in Monmouth County, Ocean County, Middlesex County, and adjoining counties in central New Jersey.
How Long Does an Uncontested Divorce Take?
A lot of people have misconceptions of uncontested divorces. If a divorce is “uncontested,” that means that either there is nothing to fight over or you have resolved all of your issues via a settlement agreement. There are cases where parties are 100% in agreement over everything before anyone actually files for divorce. In those rare cases, your agreement would need to be written into a settlement agreement and then you can proceed with a divorce, which would likely only take a few months to finalize.
Rest assured, we’re not going to take shortcuts with so much at stake for your future. Our top priority is to protect your long-term interests as we guide you through the divorce process.
Here is something you can count on: We will never create a dispute or problem that didn’t exist before you walked through our door.
