What Is the Typical Process for Obtaining a Divorce in Ocean County, New Jersey?

What Is the Typical Process for Obtaining a Divorce in Ocean County, New Jersey?

Each divorce case is different. Your case proceeds through the family court based on the factors relevant to your case. However, the divorce process in each divorce in Ocean County begins by filing a divorce complaint with the court.

You are the plaintiff when filing for divorce. Your spouse will be the defendant. Our Ocean County divorce attorneys prepare and file the complaint and handle serving the complaint on your spouse.

From this point, your divorce case could take one of several paths. If your spouse does not reply to the divorce complaint by the deadline, our lawyers file a motion for a default hearing. The judge bases the final divorce decree on our allegations in the divorce petition and the evidence we present at the hearing.

If your spouse files a response to the divorce complaint, both parties must file a Case Information Sheet, which provides details about each spouse’s financial status. After receiving the CIS forms, we proceed with the following:

  • Negotiations to obtain an acceptable divorce settlement to propose to the court.
  • If negotiations fail, your case proceeds to the next stage, participation in the Early Settlement Panel Process. The process provides recommendations for resolving disputes. The recommendations are non-binding.
  • The next phase is economic mediation if you and your spouse have not reached a settlement. Many spouses reach a settlement at this phase. If not, the case is referred for intensive settlement conferences.

If all settlement attempts fail, your divorce case is scheduled for trial. A family court judge hears the evidence and issues a final divorce decree resolving all divorce issues in dispute. In some cases, the court decides all matters related to the divorce, or the couple might only dispute one or two matters.

Our Ocean County divorce lawyers at The Law Office of Jennifer J. McCaskill, LLC, are highly-skilled family law mediators and trial lawyers. We work diligently to resolve your family & divorce law matters through settlement negotiations. However, we are prepared to go to trial if that is in your best interest.

Family Law Cases Our Ocean County Family & Divorce Lawyers Handle in New Jersey

Our Ocean County divorce attorneys have substantial experience in all family law matters. Our primary practice areas include, but are not limited to:

Divorce

New Jersey refers to divorces as dissolution of marriage. It is the legal process of ending a marriage. All matters relevant to the divorce are included in a final divorce decree, including spousal support, custody, and property division.

You can obtain a no-fault divorce in New Jersey on the grounds of irreconcilable differences. The state also has several fault grounds, including but not limited to adultery, desertion, and addiction.

Child Custody

Child custody issues are decided based on the best interests of the child. Generally, the courts encourage parents to work together to develop a parenting plan that benefits the children and promotes a continuing relationship with both parents. The legal presumption is shared custody, which allows both parents to participate in the decisions impacting their child unless the court finds a parent is unfit to have custody.

Child Support

Parents have an obligation to provide financial support for their child, even though the parents might not be together or live with the child. New Jersey uses standard child support guidelines to calculate the amount of the child support obligation. Typically, the custodial parent receives the child support payments since the child resides primarily with that parent, even in shared custody arrangements.

Property Division

New Jersey is an equitable distribution state for property division in a divorce. If a couple cannot agree on how to divide their marital assets, a judge will decide what is fair and equitable. Fair does not always equate to a 50-50 split. Judges may consider numerous factors when deciding how to divide marital assets.
