What Is the Divorce Process in Somerset County, New Jersey?

You begin the divorce process in Somerset County by filing a petition for divorce. You are known as the petitioner/plaintiff. Your spouse is known as the respondent/defendant. We serve a copy of the divorce complaint on your spouse.

Your spouse has a deadline for responding to the divorce complaint. If they fail to respond, we can request a default divorce judgment. The judge decides the divorce terms based solely on your evidence and testimony.

If your spouse responds to the complaint, the divorce process may proceed in several different ways. We will attempt to negotiate divorce terms with your spouse. If you and your spouse agree, we’ll proceed with an uncontested divorce by filing a proposed divorce settlement agreement with the court for approval.

However, the divorce is contested if you and your spouse do not agree on all terms. We will proceed with an Early Settlement Panel for economic mediation. We’ll move to more intensive settlement conferences if we cannot resolve the differences during this phase.

If all attempts at settlement fail, the case moves to a trial. The judge hears evidence from both parties and issues a final divorce judgment.

Contested divorces are costly, time-consuming, and emotionally draining. Our Somerset County divorce lawyers will work with you to settle the divorce terms through negotiations with your ex-spouse. However, we are skilled trial lawyers who do not hesitate to advocate for our clients in court.

Family Law Matters Our Somerset County Family Lawyers Handle

Our Somerset County divorce attorneys can handle all matters related to your divorce. We are well-versed in all family law matters, including but not limited to:

Divorce is called dissolution of marriage in New Jersey. It is the legal process of ending a marriage. All matters related to your divorce are included in the final divorce decree issued by the court.

New Jersey allows divorces on several fault grounds but also grants divorces on the no-fault grounds of irreconcilable differences. One spouse must be a resident for one year to file for divorce in New Jersey unless they are filing on the grounds of adultery.

Property Division

New Jersey is an equitable distribution state for asset division in a divorce. Spouses can negotiate a property division agreement to propose to the court. If they cannot agree on how to divide their marital assets, the judge decides what is fair and equitable, which may or may not be a 50-50 split.

Alimony and Spousal Support

Alimony or spousal support is not guaranteed under New Jersey divorce laws. However, judges can award alimony if they determine support is necessary and justified.

Judges consider numerous factors when determining whether to grant alimony, including the duration of the marriage, the standard of living during the marriage, and the resources of each spouse.

Child Custody and Child Support

New Jersey child custody laws require judges to decide cases based on the best interests of the child. Parents are encouraged to work together to develop a parenting plan. However, judges have the authority to modify the agreement if the agreement is not in the child’s best interest.

The state uses standard child support guidelines to determine child support obligations. Child support is based on the income of each parent and the time the child spends with each parent. Judges can deviate from the guidelines.
