What Is the Divorce Process in Somerset County, New Jersey?

You begin the divorce process in Somerset County by filing a petition for divorce. You are known as the petitioner/plaintiff. Your spouse is known as the respondent/defendant. We serve a copy of the divorce complaint on your spouse.

Your spouse has a deadline for responding to the divorce complaint. If they fail to respond, we can request a default divorce judgment. The judge decides the divorce terms based solely on your evidence and testimony.

If your spouse responds to the complaint, the divorce process may proceed in several different ways. We will attempt to negotiate divorce terms with your spouse. If you and your spouse agree, we’ll proceed with an uncontested divorce by filing a proposed divorce settlement agreement with the court for approval.

However, the divorce is contested if you and your spouse do not agree on all terms. We will proceed with an Early Settlement Panel for economic mediation. We’ll move to more intensive settlement conferences if we cannot resolve the differences during this phase. 

If all attempts at settlement fail, the case moves to a trial. The judge hears evidence from both parties and issues a final divorce judgment.

The state uses standard child support guidelines to determine child support obligations. Child support is based on the income of each parent and the time the child spends with each parent. Judges can deviate from the guidelines.
