Middlesex County is located in central New Jersey, next to Monmouth County. It has the third highest population in New Jersey, according to the 2020 U.S. Census. The county seat is New Brunswick.

The first inhabitants of the region were the Lenni Lenape tribe. They developed trails that would become roads. The early road system developed into one of the nation’s most extensive transportation networks, with most primary north-south roadway and rail routes along the East Coast going through Middlesex County.

The area thrived and became a trading and port hub in the early colonial days. In 1886, Johnson & Johnson established its world headquarters in Middlesex County. The county had the first Vocational-Technical School System in the nation and the first County College in the State.

What Is the ‘Typical’ Process For a Divorce in Middlesex County, New Jersey?

The divorce process in Middlesex County begins by filing a divorce complaint. The spouse filing the complaint is the plaintiff. They seek a divorce from their spouse, the defendant in the complaint.

We will serve the divorce complaint on your spouse. Your spouse can respond to the pleadings by filing an appearance, answer, and/or counterclaim.

The divorce process takes a different route depending on whether your spouse files a response. If your spouse does not respond, we’ll petition for a hearing and default divorce judgment.

When a spouse responds, the next step is to file a Case Information Statement or CIS. The CIS provides details of your financial status.

If you and your ex-spouse are amicable, we will try to negotiate a divorce settlement agreement to propose to the court. However, when we cannot negotiate an agreement, you and your spouse must participate in the Early Settlement Panel process. The process results in non-binding recommendations to resolve disputed matters.

Parties who cannot agree on a divorce settlement with the help of the Early Settlement Panel must proceed to economic mediation. Most parties can resolve their disputes at this point. Those who cannot move on to intensive settlement conferences.

When all settlement attempts fail, the divorce case moves to trial. The court sets a hearing date. Each party may present evidence and testimony supporting their positions.

The judge decides the matters for the couple and issues a final divorce decree. Litigated divorces are time-consuming and costly. Therefore, that route is reserved for cases with no other reasonable settlement option.

Our Middlesex County divorce lawyers at The Law Office of Jennifer J. McCaskill, LLC are talented negotiators and skilled trial attorneys. We diligently try to settle divorce cases through settlement negotiations but are prepared to argue in court when necessary.

Family Law Cases We Handle in New Jersey

Our Middlesex County divorce lawyers are well-versed and experienced in all family law matters. Our primary practice areas include:

Divorce

A divorce is the legal process of ending a marriage in New Jersey. The courts refer to the process as dissolution of marriage. All matters relevant to ending the marriage are included in a final divorce decree.

New Jersey permits no-fault divorces on the grounds of irreconcilable differences but also permits spouses to petition for divorce on fault grounds. At least one spouse must be a bona fide or actual resident for at least one year. However, the one-year requirement does not apply if the spouse files for divorce on the grounds of adultery.

Child Custody

New Jersey child custody laws promote a continuing relationship with both parents unless a parent is unfit or the relationship is harmful to the child. All child custody decisions are based on the child’s best interest. However, the legal presumption is that parents should share custody and have an equal voice in decisions regarding their children.

Child Support

Children have a right to financial support from their parents. Therefore, parents who are not together are expected to contribute to the child support obligation. Generally, the custodial parent receives child support payments.

Support is based on standard child support guidelines. The guidelines use the income of each parent and the time the parents spend with the child as a basis for support. However, the base amount can be adjusted by the court.

Property Division

The division of marital assets in New Jersey is based on equitable distribution. Therefore, if the court decides how to divide marital property, it will decide based on what is fair based on the facts of the case.

“Fair” is not always a 50-50 split. A judge can consider numerous factors, including non-financial contributions by a stay-at-home parent. Separate property is not included in property division
