What Is the Typical Process for a Divorce in Little Silver, New Jersey?

No two divorce cases are alike. Each case is based on the individuals and their circumstances. Therefore, our Little Silver divorce attorneys at The Law Office of Jennifer J. McCaskill, LLC, provide personalized legal services for each client. We develop customized legal solutions based on the factors involved in your case.

However, there is a typical divorce process in Little Silver that most cases follow. Each divorce case begins with filing a divorce complaint with the family court.

The person filing for divorce is the plaintiff/petitioner, and the other spouse is the defendant/respondent. Our Little Silver divorce attorneys take care of all steps to prepare, file, and serve the divorce complaint. A divorce can take several different paths after the divorce complaint is filed.

When a spouse does not respond to the divorce complaint, we can file a motion for default judgment. At the hearing, the judge considers the evidence we represent and your request for relief (i.e., a divorce, property division, custody, etc.). The judge can issue a default divorce decree based solely on your evidence and testimony.

However, the divorce process is different if your spouse files a response or an answer to the divorce complaint. You and your spouse must file a Case Information Sheet with the court to disclose your financial status. The information is necessary for settlement negotiations.

We attempt to negotiate a divorce settlement privately with your spouse through their divorce lawyer. When a private settlement is impossible, the spouses must cooperate with the Early Settlement Panel. The panel offers non-binding recommendations for settlement.

If either party rejects the recommendations of the Early Settlement Panel, they must participate in economic mediation. When economic mediation fails, the final step is intensive settlement conferences.

Most couples agree to a divorce settlement at one of the stages in the pre-trial divorce process. If not, the court schedules a date for a trial. Both parties present evidence, and the judge makes a final decision to resolve the disputed issues.

Our Little Silver divorce lawyers at The Law Office of Jennifer J. McCaskill, LLC, are highly skilled divorce mediators. We work diligently to resolve disputes through mediation, but are prepared to take your case to trial if necessary.

Family Law Cases Our Little Silver Family & Divorce Lawyers Handle

Our Little Silver family law attorneys at The Law Office of Jennifer J. McCaskill, LLC, have experience handling all matters related to family law. Primary practice areas our attorneys handle include:

Divorce

Divorces are referred to as dissolution of marriage in New Jersey. It is the only process to end a marriage legally. Divorce actions decide all matters related to the divorce, including custody, division of marital assets, and support.

New Jersey divorce laws provide for no-fault divorces on the grounds that the marriage is irretrievably broken because of irreconcilable differences. However, you can also file on fault grounds, including but not limited to addiction, desertion, and adultery.

Child Custody

Parents are encouraged to work together to develop a parenting plan for physical and legal custody. The presumption is to share joint custody so both parents can participate in raising their children.

However, when parents disagree about custody terms, the court decides for them. Judges base child custody on what is in the child’s best interest.

Child Support

Parents are legally responsible for providing for their child’s needs until their child is emancipated. New Jersey has standard child support guidelines to calculate the base child support obligation. Judges may deviate from the child support guidelines for numerous reasons.

Property Division

Marital property is subject to equitable division in New Jersey. If the spouses do not negotiate a property settlement agreement, a judge decides what is fair for dividing marital property. Judges consider numerous factors when deciding what is fair, which may or may not result in an equal division of assets.
